General Terms and Conditions (T&C) for Paragliding Passenger Flights with Rigi Gliders

1. Contract Formation and Validity
Rigi Gliders facilitates passenger paragliding flights. Its role is limited to organizing these flights, potentially offering additional services, and collecting the flight fee. The flights are conducted by independent pilots. The actual transport contract is concluded directly between the pilot and the passenger. These terms and conditions apply to the transport contract.
The T&C are presented to the passenger during the online booking process on the Rigi Gliders website and must be accepted when booking a flight. By confirming the booking, the passenger acknowledges that they have read, understood, and accepted these T&C. To enhance readability, the masculine form is used for all persons, but all genders are included.
Should individual provisions of these T&C be partially or entirely invalid or unenforceable, the validity of the remaining provisions remains unaffected.

2. Payment
The flight fee must always be paid in full before the flight. Payment can be made via TWINT, PDF invoice, or credit card.
Prices in foreign currencies are calculated and adjusted based on the current exchange rate.

3. Responsibility of the Pilot
The pilot responsible for conducting the passenger flight holds the necessary official certification. The pilot is the commander of the tandem paraglider, and the passenger is obligated to follow their instructions. The tandem paraglider used is suitable for passenger flights and properly maintained. The pilot carries emergency equipment (reserve parachute).

4. Health Requirements
The passenger confirms they do not suffer from health issues (physical or mental) that could affect the safe execution of a paragliding flight. If in doubt, the passenger must inform Rigi Gliders or the assigned pilot at the latest during pre-flight preparations. A joint decision will then be made on whether the flight can proceed. The final decision lies with the pilot.

5. Liability and Insurance
The passenger acknowledges that participating in a paragliding flight carries inherent risks. For instance, as the paraglider’s landing gear comprises the legs of both pilot and passenger, injuries may occur during hard landings or aborted takeoffs. Sudden, unpredictable wind conditions cannot be entirely ruled out.
The pilot has liability insurance covering up to CHF 5,000,000. The pilot’s liability for bodily injury and property damage sustained by the passenger during the flight is limited to this amount.
The passenger confirms they are personally insured against accident consequences, including those occurring during paragliding flights. Rigi Gliders or the pilot does not provide accident insurance.

6. Scheduling, Location, Duration, and Cancellations by the Organizer
Flight dates are agreed upon in advance, including short notice. Changes to the scheduled date may be necessary due to weather or organizational reasons. The pilot has the final say on whether a flight can proceed. Flights will be rescheduled for the next available date whenever possible. If rescheduling is not feasible and the cancellation was not caused by the passenger, the flight fee will be refunded.
The duration of the flight depends on weather conditions. If a minimum flight duration was promised but not achieved, the passenger may request a proportional refund based on the actual versus promised flight time.
Further claims against the organizer are excluded.

7. Cancellations by the Passenger
Individuals:
• Cancellations more than 7 days before the agreed date are free of charge.
• Cancellations between 7 days and 48 hours before the flight incur a 50% fee.
• Cancellations less than 48 hours before the flight are fully charged.

Group Reservations:
• Cancellations more than 14 days before the agreed date are free of charge (an organizational fee may apply).
• Cancellations between 14 and 72 hours before the flight incur a 50% fee.
• Cancellations less than 72 hours before the flight are fully charged.

8. Minors and Legally Incapacitated Passengers
Minors or legally incapacitated passengers require the consent of a legal guardian or representative.
If this person is not present at the flight, written consent must be submitted to the pilot in advance.

9. Use of Mobile Phones and Cameras
The responsible pilot independently decides whether and how mobile phones and cameras may be used during the flight.
Most pilots permit the use of compact cameras (e.g., GoPro), which must be securely attached. The pilot determines the appropriate attachment method. Mobile phones and cameras with interchangeable lenses are generally not allowed during the flight unless explicitly approved by the pilot under certain safety conditions.

10. Jurisdiction for Passengers from the USA or Canada
Passengers from the USA or Canada explicitly waive jurisdiction in their home countries for disputes arising from the flight. They acknowledge that neither Rigi Gliders (Arth, SZ) nor the pilot will accept jurisdiction in the USA or Canada. Swiss law exclusively applies.

11. General Jurisdiction and Applicable Law
For all disputes arising from the flight contract, the ordinary courts at the location of Rigi Gliders (Arth, SZ) have jurisdiction. Swiss law exclusively applies.
